These Terms of Service are a legal agreement between you and Temari Battle Systems Inc. (“Temari,” “we,” “us,” or “our”).
They apply when you visit temari.ai, join the Founders List, reserve or buy a product, use the Temari app, connect Temari hardware, use Temari software or firmware, participate in Temari gameplay, League features, events, community features, creator programs, support, or any other Temari product or service.
Temari is a connected robot battle game involving the Temari app, Battle Units, Mechs, Legends, AR battles, physical robot battles, optional Tower-enabled play, League features, events, accessories, replacement parts, and related products and services.
By using Temari, you agree to these Terms. If you do not agree, do not use Temari.
Some countries, states, or regions give consumers mandatory legal rights. Nothing in these Terms limits rights that cannot legally be limited.

1. Who can use Temari
You may use Temari if you are old enough to agree to these Terms under the laws where you live.
If you are under that age, your parent or guardian must agree to these Terms for you and is responsible for your use of Temari.
Temari’s expected play age may be different from the age needed to create an online account, join a mailing list, make purchases, or give legal consent. Where required, accounts, purchases, communications, and child features must be handled by a parent or guardian.
We may refuse, suspend, or close an account if we believe these Terms have been broken, if a user is too young to use a feature, if required parental consent has not been provided, or if we need to protect users, Temari, or the public.
2. Prelaunch status and Founders List
Temari is currently a prelaunch product. Information on the website, in videos, in press materials, or in community updates may describe prototypes, planned features, expected products, concept art, tests, or future goals.
Joining the Founders List, signing up for updates, or reserving interest does not guarantee that any product, feature, price, launch date, launch region, game mode, accessory, Legend, Mech, Tower, event, or service will become available.
Unless we clearly say otherwise at checkout, joining the Founders List does not require payment, does not create a preorder, and does not guarantee a place in line.
We may change, delay, redesign, reprice, rename, remove, replace, or cancel planned products, kit contents, product bundles, features, community unlocks, launch regions, launch timing, gameplay systems, digital items, app features, or events before launch.
Public statements about future features are not binding commitments unless they are included in the final product description at the time you place a paid order.
3. Accounts
Some Temari features may require an account.
You agree to give accurate account information and keep it up to date. You are responsible for activity on your account and for keeping login details secure.
Do not share an account in a way that avoids rules, age restrictions, purchase limits, safety restrictions, event rules, or sanctions controls. Tell us promptly if you believe your account has been accessed without permission.
4. Product descriptions, availability, and changes
We try to describe Temari products and services accurately. However, prelaunch materials, prototypes, images, renders, videos, packaging, gameplay examples, app screens, and feature descriptions may change.
Product images may not exactly match final products. Colors, packaging, accessories, dimensions, components, firmware behavior, app screens, compatibility, features, game balance, and availability may change.
We may limit quantities, refuse orders, cancel orders, correct errors, or withdraw products from sale where allowed by law.
We may update Temari after launch. Updates may add, remove, rebalance, rename, redesign, restrict, or change features, digital content, compatibility, performance, game rules, leaderboards, events, rewards, anti-cheat systems, safety features, or supported hardware.
We will not intentionally remove core paid functionality from a launched paid product without a reasonable reason, such as safety, security, legal compliance, technical feasibility, product support, anti-cheat, abuse prevention, platform requirements, or replacement with a reasonably similar feature.
Some features may require internet access, Bluetooth, camera/AR permissions, location permissions, firmware updates, app updates, compatible devices, accounts, region availability, or third-party platform services.
5. Software, app, and firmware license
Temari software, app content, firmware, game systems, website content, AR content, audio, video, characters, Legends, Mechs, graphics, names, logos, code, and other digital materials are licensed, not sold.
Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use Temari software, firmware, and digital content only as intended with Temari products and services.
You may not: • copy, sell, rent, sublicense, or commercially exploit Temari software or digital content; • reverse engineer, decompile, modify, or attempt to extract source code except where the law allows this; • use Temari software with unauthorized hardware or accessories; • bypass safety, security, age, payment, anti-cheat, territorial, or access controls; • interfere with Temari systems, servers, rankings, events, or other users; • use bots, cheats, scripts, exploits, unauthorized automation, or data scraping; • use Temari to infringe anyone’s rights or break the law.
Some Temari software may include open-source components. Open-source components are governed by their own licenses where applicable.
6. Updates
Temari products may require app, firmware, software, or security updates. Some updates may be required for safety, legal compliance, compatibility, anti-cheat, bug fixes, performance, or continued use of online features.
We may install or require updates automatically where permitted by law and platform rules. Features may not work correctly if updates are not installed.
We may stop supporting older app versions, firmware versions, devices, operating systems, or hardware revisions where reasonably necessary.
7. Digital items, Legends, progression, and game balance
Temari may include digital Legends, Mech identities, abilities, skins, cards, rewards, inventory, rankings, progression, event access, or other digital items.
Unless we clearly say otherwise, digital items are licensed for use inside Temari. They are not money, cryptocurrency, securities, stored value, gift cards, or property outside the Temari service. They have no cash value and cannot be redeemed for cash.
We may change, rebalance, rename, restrict, remove, or replace digital items, abilities, stats, rankings, rewards, factions, battle rules, rarity systems, drop rates, event rules, or progression systems to improve gameplay, protect users, comply with law, fix bugs, prevent cheating, or maintain the Temari ecosystem.
Trading or transferring digital items is allowed only through official Temari features, if available. Unofficial sales, transfers, account sales, or attempts to sell digital items for money are not allowed.
8. Hardware use and safety
Temari hardware is designed for play, but it includes moving parts, electronics, batteries, accessories, and physical interaction.
You agree to:
• read and follow all instructions, warnings, manuals, app prompts, and safety guidance; • use Temari only as intended; • supervise children where appropriate; • use Temari in safe spaces and on suitable surfaces; • keep Temari away from hazards, liquids, heat, pets, hair, loose clothing, stairs, roads, fragile objects, and unsafe areas; • stop using damaged products until they are repaired or replaced; • use only approved chargers, batteries, accessories, replacement parts, and firmware where required; • avoid modifying, disassembling, overloading, or tampering with Temari hardware unless we specifically allow it.
Do not use Temari products to harm people, animals, property, or other products. Do not use Temari in a way that is unsafe, illegal, abusive, competitive outside agreed rules, or contrary to instructions.
Damage caused by misuse, unsafe play, unauthorized modifications, unauthorized parts, improper charging, water damage, abuse, neglect, accidents, or failure to follow instructions may not be covered by warranty.
9. Community, League, rankings, and events
Temari may offer League features, rankings, faction competition, creator battles, roadshows, tournaments, events, community challenges, or premium formats.
We may set rules for each event, competition, League, ranking, creator program, or community feature. Those rules become part of these Terms.
We may change or reset rankings, reject entries, disqualify users, remove rewards, suspend accounts, or cancel events if we believe there has been cheating, manipulation, unsafe behavior, harassment, abuse, fraud, technical error, legal issue, or other behavior that harms Temari or other users.
Unless we clearly say otherwise, rankings, rewards, digital items, or event participation do not have cash value.
Travel, equipment, taxes, permissions, and local compliance are your responsibility unless event rules say otherwise.
10. User content and feedback
You may send us feedback, ideas, suggestions, comments, images, videos, gameplay clips, testimonials, bug reports, creator materials, or other content.
You keep ownership of content you already own. By submitting content to Temari, you give us a worldwide, royalty-free, transferable, sublicensable license to use, copy, edit, display, distribute, publish, translate, make derivative works from, and promote that content for Temari business, product, community, press, marketing, support, and development purposes.
You confirm that you have the rights needed to submit the content and that it does not infringe anyone’s rights, violate privacy, contain harmful code, or break the law.
For private support communications, we will use your content mainly to provide support, improve products, investigate issues, and protect users.
We may remove or refuse content for any reason, including if we believe it is unsafe, unlawful, infringing, misleading, abusive, hateful, sexual, exploitative, harassing, spam, or inconsistent with Temari’s community standards.
11. Rules of conduct
Do not use Temari to:
• break the law; • harm, threaten, harass, abuse, exploit, or deceive others; • collect personal information from others without permission; • impersonate anyone; • upload malware or harmful code; • cheat, exploit bugs, manipulate rankings, or disrupt gameplay; • bypass safety, payment, region, account, parental, or security controls; • infringe Temari’s rights or anyone else’s rights; • scrape, copy, or mine data without permission; • sell, resell, or commercially exploit Temari services without permission; • use Temari in a dangerous or unauthorized physical setting.
We may investigate suspected violations and take action, including warnings, content removal, account suspension, account closure, device restrictions, event disqualification, order cancellation, or reporting to authorities.
12. Purchases, reservations, preorders, and payments
When ecommerce opens, Temari may sell hardware, accessories, replacement parts, digital content, services, event access, subscriptions, extended warranties, or other products.
Product pages and checkout will show the product, price, taxes, shipping costs, delivery estimates, payment terms, and any important limitations available at that time.
A paid order is not accepted until we confirm acceptance. We may refuse or cancel orders where allowed by law, including for suspected fraud, payment failure, pricing errors, availability issues, shipping restrictions, age restrictions, reseller activity, or legal compliance.
For preorders or paid reservations, the checkout page will explain whether payment is charged immediately, authorized only, refundable, partly refundable, or converted into a later order. Preorder dates are estimates unless we expressly say they are guaranteed.
We may correct pricing, product, availability, or checkout errors. If an error affects your order, we may cancel the order and refund you, or ask whether you want to continue on corrected terms where required.
You are responsible for taxes, customs duties, import fees, and similar charges unless checkout says they are included.
Payments are handled by third-party payment processors. We do not directly store full payment card details.
13. Shipping, delivery, and risk
Delivery times are estimates unless we expressly guarantee them. We will provide delivery information during checkout.
For consumer orders, risk of loss or damage passes to you when the goods are delivered to you or to someone you identify to receive them, unless applicable law says otherwise.
For business orders, risk may pass according to the shipping terms shown at checkout or in a separate written agreement.
If we cannot ship within the promised time, we will notify you and give you the options required by applicable law, which may include agreeing to a delay or receiving a refund.
We may restrict shipping to certain countries, regions, addresses, or product types.
14. Returns and cancellation rights
Our voluntary return policy will be shown at checkout or on our returns page when ecommerce launches.
Unless a different policy is shown, consumers may request a return of unused, complete, undamaged physical products in original packaging within 30 days after delivery.
Some items may not be returnable unless faulty, including opened consumables, used replacement parts, personalized items, custom products, downloadable digital content, event tickets tied to specific dates, or sealed items that cannot be returned for health, hygiene, or safety reasons after opening.
You must contact support@temari.ai before returning a product so we can provide return instructions.
For non-defective voluntary returns, you may be responsible for return shipping unless local law or our checkout terms say otherwise. We may reduce a refund for missing parts, damage, or use beyond what is needed to inspect the product, where allowed by law.
EU and UK consumers may have additional cancellation rights for online purchases. In many cases, you have 14 days after delivery of physical goods to cancel without giving a reason. You may then have to return the goods within the period required by law. We will refund eligible payments, including standard delivery where required, within the time required by law.
For digital content or digital services supplied immediately, you may lose cancellation rights where you expressly agree to immediate supply and acknowledge that you lose the right to cancel, where local law allows this.
Nothing in this section limits mandatory legal rights.
15. Warranty
Temari-branded hardware purchased from Temari or an authorized seller is covered by a limited warranty against defects in materials and workmanship under normal use for one year from the date of delivery, unless a longer period is required by law or stated at checkout.
This limited warranty may cover Battle Units, Mechs, Towers, Charge Cases, official accessories, and other Temari-branded hardware. It does not cover software as hardware, digital content, or third-party products.
The warranty does not cover:
normal wear and tear; consumable or high-wear parts such as batteries, wheels, tires, armor, shells, or similar parts, unless defective when supplied; cosmetic damage that does not affect function; damage caused by misuse, unsafe play, abuse, accidents, liquids, heat, improper charging, unauthorized repair, unauthorized modification, unauthorized parts, failure to follow instructions, or use outside intended purposes; products with removed or altered serial numbers; counterfeit or unauthorized products; damage caused by third-party hardware, accessories, software, or services.
If a covered defect appears during the warranty period, we may repair the product, replace it with a new or refurbished equivalent, provide replacement parts, or refund the purchase price, as allowed by law.
Replacement products or parts may be new, refurbished, or functionally equivalent. They will be covered for the remainder of the original warranty period or 90 days, whichever is longer, unless local law requires more.
To request warranty service, contact support@temari.ai with proof of purchase, product details, and a description of the issue. You must follow reasonable diagnostic, return, packaging, and service instructions.
This limited warranty is in addition to any mandatory consumer rights you may have.
16. Consumer legal rights
Consumers may have legal rights that cannot be excluded or limited.
For example, depending on where you live, products may need to match their description, be of satisfactory or acceptable quality, be fit for ordinary use, include expected instructions and accessories, and receive required updates.
Digital content and digital services may also need to match their description, work with stated functionality and compatibility, and receive required updates.
Nothing in these Terms removes or limits those mandatory rights.
If these Terms conflict with mandatory consumer law, the mandatory consumer law controls.
17. Subscriptions and paid digital services
Temari may later offer subscriptions, memberships, premium events, paid digital content, or other paid services.
Subscription terms, billing period, price, renewal, cancellation method, trial rules, and any minimum commitment will be shown before you subscribe.
Unless local law requires otherwise, subscriptions renew until cancelled. You can cancel using the method provided in your account, app store, checkout provider, or support flow.
Cancelling a subscription stops future billing but may not automatically refund past charges unless required by law or stated in the subscription terms.
18. Third-party services and platforms
Temari may rely on third-party services, including app stores, payment processors, shipping providers, analytics tools, video platforms, social platforms, event partners, cloud providers, or community platforms.
Those third parties may have their own terms and privacy policies. We are not responsible for third-party services we do not control.
Your use of the Temari app may also be subject to Apple App Store, Google Play, console, platform, or device terms.
19. Intellectual property
Temari and its licensors own the Temari name, logos, characters, Legends, factions, Mechs, artwork, videos, stories, software, firmware, designs, game systems, website content, app content, packaging, and other intellectual property.
You may not use Temari intellectual property without permission except as allowed by these Terms, official fan/creator guidelines, or law.
Press and creator use may be allowed through our press kit, creator guidelines, or written permission. We may update those guidelines at any time.
20. Copyright complaints
If you believe content on Temari infringes your copyright, contact us at legal@temari.ai with:
• your name and contact details; • a description of the copyrighted work; • the location of the allegedly infringing content; • a statement that you believe in good faith that the use is not authorized; • a statement that your notice is accurate and that you are authorized to act; • your physical or electronic signature.
We may remove content and take action against repeat infringers where appropriate.
21. Privacy
Our collection and use of personal information is described in our Privacy Policy.
By using Temari, you acknowledge that we will process personal information as described in the Privacy Policy.
22. Service availability
Temari services may be unavailable, interrupted, delayed, changed, or discontinued because of maintenance, updates, outages, security issues, third-party services, app-store rules, safety issues, legal requirements, region restrictions, or events outside our control.
We do not guarantee that online features, servers, events, rankings, digital content, community features, or third-party integrations will always be available.
We may suspend or discontinue services or features where reasonably necessary.
23. Disclaimers
To the fullest extent allowed by law, Temari services, software, digital content, beta features, prelaunch materials, community features, rankings, events, and online services are provided “as is” and “as available."
We do not promise that Temari will be uninterrupted, error-free, cheat-free, compatible with every device, available in every region, or free from bugs.
This disclaimer does not limit mandatory consumer rights, product safety obligations, or rights that cannot legally be waived.
24. Limitation of liability
Nothing in these Terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, fraud, intentional misconduct, or mandatory consumer rights.
To the fullest extent allowed by law, Temari will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, business interruption, loss of opportunity, or loss of expected features.
To the fullest extent allowed by law, Temari’s total liability for claims relating to a product or service will not exceed the amount you paid for that product or service in the 12 months before the claim, or USD $100 if no payment was made.
This section applies only where allowed by law.
25. Indemnity
If you use Temari on behalf of a company or other organization, that organization agrees to indemnify Temari for claims arising from your breach of these Terms, your misuse of Temari, or your violation of law or third-party rights.
For individual consumers, this indemnity applies only to the extent allowed by local law.
26. Changes to these Terms
We may update these Terms from time to time. If changes are minor, we may post the updated Terms on the website or app.
If changes are material, we will take reasonable steps to notify users, such as by email, app notice, website notice, or account notice.
The updated Terms apply from the effective date stated in the notice or posted Terms. If you continue using Temari after the effective date, you accept the updated Terms.
For paid products or services already purchased, changes will not reduce your mandatory consumer rights.
27. Termination
You may stop using Temari at any time.
We may suspend or terminate your access to Temari if:
• you break these Terms; • we believe your account is being used unsafely, fraudulently, illegally, or abusively; • required parental consent is missing; • payment fails; • we need to protect users, Temari, or third parties; • we stop offering a service or feature; • we are required to do so by law, platform rules, or safety requirements.
After termination, sections that by their nature should survive will continue, including intellectual property, user content licenses, payment obligations, warranty limits, disclaimers, liability limits, dispute terms, and governing law.
28. Governing law and disputes
These Terms are governed by the laws of Denmark, except where mandatory consumer law gives you rights under the laws of your country, state, province, or region.
Before starting a formal dispute, please contact support@temari.ai so we can try to resolve it informally.
If you are a consumer, you may bring claims in the courts or forums available under your mandatory local consumer laws.
If you are a business user, any dispute arising from these Terms or Temari products or services will be resolved exclusively in the courts of Denmark, unless we both agree otherwise in writing.
No arbitration clause applies to EU or UK consumers unless it is separately agreed after a dispute arises and is valid under applicable law.
For U.S. consumers, Temari may later add arbitration or class-action terms, but only if presented clearly and in a way that complies with applicable law. Until then, disputes may be brought in courts that have lawful jurisdiction.
29. Force majeure
We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, supply-chain disruptions, shipping disruption, customs delays, internet or power failures, cyberattacks, pandemics, government action, legal restrictions, app-store restrictions, certification delays, or failure of third-party services.
We will use reasonable efforts to reduce the effect of such events.
30. Assignment
You may not transfer your rights or obligations under these Terms without our written permission.
We may transfer our rights or obligations to an affiliate, successor, buyer, investor, acquirer, or other party involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction.
31. Export and sanctions
You must comply with applicable export control, sanctions, customs, and trade laws.
You may not use, buy, export, re-export, or transfer Temari products, software, or services in violation of those laws.
32. Entire agreement
These Terms, the Privacy Policy, product-specific terms, checkout terms, event rules, creator guidelines, and any written terms we expressly provide for a specific product or service form the agreement between you and Temari.
If any part of these Terms is unenforceable, the rest remains in effect.
Our failure to enforce a term does not waive our right to enforce it later.
